Confessions on a dance floor? This time Madonna has been ordered by a federal judge to ‘fess up in court as a lawsuit over her Hard Candy gyms heats up, RadarOnline.com has exclusively learned.

Florida-based beauty company Hard Candy alleges the Material Girl and her business partner stole their company name, and are suing for copyright infringement. ​Madonna owns Hard Candy gyms around the world.

Judge John O’Sullivan decided Madonna will be required to sit for a deposition, according to new court documents, but ruled that she can only answer questions pertaining to the lawsuit.

“In the event that Hard Candy’s counsel asks any further questions beyond the scope of permissible discovery during any future depositions, Defendant’s counsel is instructed to object that the question goes beyond the scope, permit the witness to answer the question, and file a motion with the Court if Sanctions are appropriate,” the ruling states.

It was further determined that Madonna and Live Nation LLC, must also turn over any licensing agreements in which merchandise is sold in Florida.

Guy Oseary, Madonna’s long time manager, won’t be required to sit for another deposition.

I work in a legal department and I don't think they have a case. People clearly aren't confused as to the branding...gyms and beauty products are in a different market and I'm certain M got clear legal advice when she chose the name. No consumers are confusing the brands. Expect this to fizzle out.

I was thinking about this part: It was further determined that Madonna and Live Nation LLC, must also turn over any licensing agreements in which merchandise is sold in Florida.

But maybe it's irrelevant that she has no gyms in the US. EDUCATE ME Stephen

Each state in the US has different rules/regulations/laws for various types of things. Florida has a bunch of weird rules like a bunch of other states. One option Madonna/HC could do is refuse to sell to any residents in Florida (where the makeup company is based), but I don't think she will. They are a makeup/beauty company, and HC is a fitness gym. If there was another gym with the same name in Florida that had a trademark before Madonna opened hers, then they would definitely have a case...but they belong to two different markets all together. I don't believe people associate M's gyms with the makeup brand. I don't see their case, and Madonna would not have named the gyms HC if there was any legal issues.

Yeah, we have the same rule in Sweden. You can use a name that's already used by a different company as long as it's in a different field.

I agree about the last part. Madonna is no fool, so her lawyers must have done the research to make sure that she could use the name.

Isn't the business named Hard Candy Fitness? Just by the addition of the word Fitness alone, they don't have a case, right?

Another person/business trying to get free publicity by using M name.....

I was wondering who was the first person to do it.. Was Camille Barbone (M's first manager) to sue Madonna? And then she practically got sued by anyone.

I couldn't care less about the gyms but I'm sure those make up brand wants to make a quick buck.
