    Madonna's million dollar baby: Singer wins court appeal to adopt Mercy after donating £12m to Malawi

    But it seems the adoption of Malawian orphan Mercy James did not come cheap.

    Madonna is reported to have donated £12million to the African state to fund orphan aid projects.

    One international welfare agency worker told the Daily Mirror: 'It smacks of bribery. How can they refuse her requests when she gives Malawi so much?'

    The money has been spent to fund six orphanages as well as paying for shoes, clothes, books and mosquito nets.

    It has taken nearly three years, but yesterday Madonna was finally free to take Mercy for a new life in America.

    The supreme court in Blantyre overturned a previous ruling that had rejected the singer's petition to adopt the four-year-old girl.

    'I am ecstatic,' Madonna said on hearing the news at her home in New York. 'My family and I look forward to sharing our lives with her.'

    She expressed thanks to the supreme court's three judges, headed by Chief Justice Lovemore Munlo.

    Earlier he had told the packed courthouse: 'Madonna has shown that she is bold and compassionate enough to come forward to adopt Chifundo Mercy James.'

    He said there were two options for Mercy: 'To stay at the orphanage without the love of family and live with the possibility of destitution, or be with Madonna where she is assured of love. Every child has the right to love and be loved.'

    He said Madonna was 'an intelligent, articulate and outgoing individual of strong character. She is also a determined, independent and hardworking person of compassion from a God-fearing family.

    'Since the early age of six when her mother died, she took on the maternal role to her younger siblings, assuming responsibility of house cleaning, cooking and babysitting.'

    Malawi's high court had turned down the singer's application in April because she was not resident in Malawi.

    But Mr Munlo said this was a 'narrow interpretation based on old laws', adding: 'The matter of residence should be determined at the time of application of the adoption. In this case, Madonna was in Malawi not by chance but by design. She specifically came here for the purpose of this application for adoption.

    'And on that day she had already adopted another infant known as David Banda from Malawi. She has plans to travel to Malawi frequently with her adopted children in order to instill in them a cultural pride and knowledge of their country of origin.'

    He added that Madonna would easily be able to care for the youngster, concluding that the singer - who is worth some £250million - was 'financially stable'.

    Despite Madonna's avowed love for the child, she was unable to make it to Malawi for the hearing and was represented by her lawyer, Alan Chinula.

    After the hearing, he said he would arrange for a passport for Mercy, which could take several days, and was awaiting word from Madonna on travel plans for the little girl.

    She will join three-year-old David Banda, who Madonna adopted two years ago, at their main home in New York.

    Like David, Mercy will exchange the orphanage for opulence. It has been reported that Madonna has just splashed out £25million on a Georgian-style townhouse in the Upper East Side. The 26-room property is said to have 13 bedrooms and 14 bathrooms. Instead of being raised in the Christian faith practised by her Malawian family, Mercy will be instructed in Kabbalah, the mystical faith followed by Madonna.

    While she was delighted with yesterday's news, it will not have been welcomed by Mercy's grandmother, Lucy Chekechiwa, who has been unwavering in her resistance to the adoption.

    Madonna came across Mercy at an orphanage during her first visit to Malawi in 2006 with her then husband, Guy Ritchie.

    She decided Mercy was 'the one', but her grandmother refused to let her go.

    So the singer instead returned home with David Banda, whom it proved easier to extricate from his father Yohane.

    Lucy's daughter, Mwandida, was Mercy's mother. She became pregnant aged 14 - the father was an older student at their school - and died from complications of childbirth days after Mercy was born.

    Mercy's father, James Kambewa, claims he was told that Mercy too had died and only learned the truth after being tracked down by journalists in April. He now says he wants his daughter back.

    In an emotional appeal, he told the Mail: 'She is my daughter, she is my blood, she needs parental love.

    'She is not an orphan. She lost one parent, yes, but I am still alive and so she is not an orphan. Madonna has millions of dollars but that doesn't make her a good mum. Parental love is more than money.'

    Vowing to fight to get his daughter back, he said: 'I will win somehow.'

    Last night, adoption charities reacted angrily to the news of the adoption ruling, saying international laws had been breached.

    EveryChild, the international children's charity, said it was 'extremely concerned' that the Malawian courts ruled in favour of Madonna.

    A spokesman said: 'Malawi has still not ratified the Hague Convention on Intercountry Adoption which raises grave concerns about the adoption process and appeal.'

    Anna Feuchtwang, chief executive of EveryChild, said: 'The court's decision to allow Madonna to adopt Mercy is disappointing and worrying on a number of levels.

    'High-profile adoptions such as this send out the wrong message. It is a shame that so much emphasis has been placed on a celebrity, rather than the real issue of the work being done in Malawi to support vulnerable families to stay together.'

    Madonna donated £12 million to help children in the poverty-stricken African state of Malawi before being granted permission to adopt a second child from the country, it has been reported.

    The country’s Supreme Court of Appeal overturned a previous ruling that stopped the pop star from taking four-year-old Mercy James to the United States.

    The 50-year-old singer said she was ecstatic with the news and added: “My family and I look forward to sharing our lives with her.”

    Madonna learned of the development in a 3am phone call from her lawyer in Malawi.

    Alan Chinula rang her in New York after the supreme court overturned the previous ruling.

    Speaking from outside the court, Mr Chinula, said: “I was just through to New York and it is the early hours but Madonna has been awake waiting for news. She was ecstatic.

    “I’m now waiting for instructions to start preparing for Mercy’s travel arrangements.”

    The Daily Mirror reported on Saturday that the singer has donated £12 million to fund six orphanages in Malawi as well as paying for shoes, clothes, books and mosquito nets for impoverished children in the country.

    Madonna has already adopted her three-year-old son named David Banda from Malawi.

    Malawi’s Chief Justice Lovemore Munlo ruled that Mercy, whose Malawian name is Chifundo, will receive a better life with the star than remaining in the impoverished state.

    Mercy’s uncle Peter Baneti said the family welcomed the ruling and added: “We hope Mercy will be joining Madonna soon.”

    The judge said: “Madonna has been judge to be a compassionate, intelligent and articulate person. Her adoption of Mercy James is not a selfish act.”

    Madonna’s previous attempt to adopt Mercy failed when a judge in a lower court said the singer did not satisfy rules that required the star to live in Malawi for 18-months before she could be allowed to adopt the youngster.

    Chief Justice Lovemore Munlo said Madonna had shown an interest in helping Malawi orphans and that 4-year-old Mercy James would have a better life with the star. He said a lower court had erred in turning down the adoption request because Madonna was not resident in Malawi.

    Madonna’s adoption lawyer in Malawi, Alan Chinula, tells Access Hollywood that online rumors of Malawi’s high court changing their tune and allowing Madonna to adopt a young girl named Mercy are, “not true at all.”

    Chinula said that the judges in Malawi are not happy about this report out there on the Web. Specifically he said that, “The Chief Justice is not very amused,” and that, “We’re very unhappy about it.”

    Chinula’s colleagues are having a meeting with the Chief Justice later today to explain that it is a misunderstanding and nothing more than a rumor circulating in the press.

    Chinula also says they are anxiously waiting for the courts to deliver the judgment, and that it could be any day. He told Access he checks in with the court clerk every day to find out if they have made a decision on the adoption.

    He added that he has not spoken to Madonna about this latest report yet.

    Chinula is very dismayed at this false report. He goes on to say that his staff are professionals and that they would never tell the press something like this before a decision had come down.

    Chinula also handled Madonna’s first adoption with David Banda, now 3.

    MADONNA has persuaded three appeal judges to allow her to adopt Malawian orphan MERCY JAMES, The Sun can reveal.

    Two have already submitted reports recommending it go ahead and the third is said to be "in complete unison with them".

    Madonna, 50, whose two-year application to adopt the three-year-old was blocked by a court in March, has been told the news by her lawyer Alan Chinula.

    The ruling is set to be announced next Sunday at Malawi's Supreme Court of Appeal.

    A source there said yesterday: "The paperwork is being typed up now.

    "All recommendations are in favour of the adoption taking place. Mercy should start packing her bags. She's off to America."

    A close friend of Madonna said: "She's ecstatic.

    "She made a promise that she wouldn't give up on Mercy and, believe me, she could move mountains when she's this determined."

    Madonna's adoption application was originally rejected because she had not lived in the east African state for 18 months, as required.

    But one of the three appeal judges has said that rule was out of date.

    The pal added: "No stone has been left unturned to prove that ruling was wrong."

    MADONNA is determined to go for an immaculate collection of kids by adopting an African baby with lover Jesus.

    The star has switched her efforts from Malawi to Nigeria, making inquiries at an orphanage in the city of Kaduna about a female tot.

    The Material Girl was devastated when her bid to adopt a little girl called Mercy was rejected by a Malawi court in April.

    This time round she is involving model boyfriend Jesus Luz, 22, to prove he can act as a responsible father.

    A source close to the 50-year-old singer revealed: "She was distraught when her adoption failed in Malawi.

    "At the time she blamed the fact that her relationship with Jesus made her look like she was going through some midlife crisis.

    "But now she's looking at adoption centres in Nigeria and has got another female friend to make an initial approach to test the waters.

    "She's determined not to make the same mistakes and feels that the only way to do this is to get Jesus involved from the off." Madonna's pal has made an approach to the Mercy Home Orphanage, which is home to 30 children.

    Our source said: "Madonna is considering visiting, perhaps with Jesus, as soon as she can."

    But she may encounter problems similar to those she faced in Malawi, which ruled out adoption because she was not resident in the country.

    Adoptive parents who have not been resident in Nigeria for at least three months find the adoption process extremely difficult.

    A source said: "Madonna has some of the best legal minds working for her and she'll be pushing them to find a loophole."

    She's determined to extend her family and provide a little sister for daughter Lourdes, 12, and sons Rocco, eight, and David, three, who she adopted in Malawi. The source continued: "Madonna always thought she would eventually win her battle to adopt Mercy, but that hasn't been the case. She thinks this will bring her and Jesus together as one big happy family."

    Her friend added: "Failure is not an option. Madonna wouldn't be able to take rejection for the second time."

    Madonna may be planning to adopt a baby from the African kingdom of Lesotho after being told to ‘expect the worst’ over her bid to become the new mother of Malawian girl Mercy James.

    Her quest for another child could be the reason why the singer and her adopted son David Banda watched Prince Harry play at a polo match in aid of his charity Sentebale in New York last weekend.

    The Prince has close links with Lesotho and Sentebale raises money for vulnerable children in the country, which has one of the highest AIDS rates in the world.

    Madonna, 50, has an appeal pending in Malawi after a High Court ruling that she could not adopt four-year-old Mercy.

    But The Mail on Sunday can reveal Madonna was warned last week that the three High Court judges considering the case are unlikely to rule in her favour when the verdict is made in open court later this month.

    The news comes almost a year to the day after she was officially granted permission to adopt three-year-old David from Malawi.

    He now lives in New York with her two natural children, Lourdes, 12, and Rocco, eight, and Madonna is said to have promised David a new sister.

    ‘Madonna is not a patient person, she’s used to getting what she wants. She has said she won’t give up on Mercy but if she’s blocked from adopting her legally then she will think about trying to adopt another baby. She has already started looking into other African countries,’ a source revealed last night.

    ‘Madonna was devastated when she was told she couldn’t adopt Mercy. Her plan now is to start the ball rolling somewhere else. She has promised David a sister and she wants another African child.

    ‘If a miracle happens and she gets to adopt Mercy, I see no reason why she wouldn’t go ahead and adopt another child from a different African country as well.

    ‘She has done some research on Lesotho and because it’s a place that is ravaged by AIDS and has a high number of orphans, it could be the perfect second choice.’

    In April, Malawian judge Esmie Chondo rejected Madonna’s application to adopt Mercy because the star does not fulfil the country’s residency requirements.

    Prospective parents have to live in Malawi for 18 months before adopting an orphan.

    But in other African countries residency is not part of the process.Madonna has sent a team of aides to Malawi in the hope that they can convince officials to let her have Mercy.

    Sources in Malawi say the singer’s chief PA, her lawyer and a handful of representatives for her charity Raising Malawi are installed at Kumbali Lodge, where Madonna stayed in April when she tried to adopt Mercy.

    But a source close to the star said: ‘Madonna has been told to expect the worst. She has a team in place in Malawi who have been campaigning tirelessly to try to facilitate the adoption. There was a private meeting between Madonna’s aides and a number of government officials last week.

    ‘Madonna’s representatives have been told the ruling, which is scheduled to be made public any day now, is not in her favour.’

    The singer argued in court papers that she was able to ‘securely provide’ for Mercy and ‘make her a permanent and established member of my family’.

    One source in Malawi said: ‘There has been a lot of activity since Madonna’s people arrived. The officials from Raising Malawi checked in to Kumbali Lodge on May 29 and are booked in to the end of the month.

    ‘The lodge is not allowing other bookings, which is what happened the last time Madonna came in. There have been several meetings with government officials at the lodge, one of whom is an aide to Joyce Banda, the Vice-President of Malawi.

    'Madonna’s team have also made several visits to Blantyre, where the Supreme Court is. No one knows when the ruling is going to be made public. But the word here is that Madonna has been told the adoption is not going to happen.’

    Madonna had hoped that the connections she has forged with Joyce Banda would help in her appeal to adopt Mercy, who is believed to be staying in a safe house.

    A source in Malawi said yesterday: ‘Joyce Banda has publicly spoken out in support of Madonna and has said on the radio that Madonna is doing a good thing. She is on the committee of the school that Madonna is involved with in Malawi and has struck up a friendship with Madonna.

    ‘Joyce is due to visit the lodge soon but she hasn’t been yet. Sadly for Madonna, even their friendship and her good connections with the government don’t appear to have helped.’

    Last night Joseph Chigona, a spokesman for the Supreme Court, said that an official decision had not yet been reached.

    ‘We will inform the nation once the three judges are ready,’ he said.

    Madonna’s US publicist last night insisted: ‘There has been no indication that a ruling is imminent. The adoption of Mercy is one of many rulings pending before the Court. There is no news on when the ruling is going to happen or that it will not be in Madonna’s favour. We remain hopeful.’

    Remember when Madonna joined the Britney bandwagon, championing her greatness and even duetting with the new star to signal the fact that she might become the new Madonna, so it was best to quickly embellish her with the old Madonna?

    But now, it turns out that Lady Gaga is way more Madonna-like than Britney ever was. The girl is much more of a player in her own image-making and seems like the visually avant-garde chameleon type that Britney, who simply synchs and swivels as she's told, is not overly interested in being. And naturally, Madonna has already put her stamp of approval on Gaga, going to her concert with the boy toy and the daughter, whose ipod she clearly raided to find out about this new phenomenon of artsy commercialism.

    Madonna's no dummy--and if Gaga turns out to be just a two-hit wonder, Madge will simply move on to the next emerging diva. But in the meantime, I give it a matter of minutes until we hear about a Madonna/Gaga duet. I'm not bluffin' with my muffin!

    According to Jesus Luz's papa, Madonna and his son are definitely tying the knot, kabbalah style.

    In a recent interview with Brazil's Quem (Who) magazine, Luis Heitor Pinto da Luz says: "The kabbalah ceremony [in New York that] will link up my son Jesus Luz and Madonna only confirms that he is extremely happy."

    But although the pair is planning a ceremony, the younger Luz most likely won't be signing a prenup anytime soon: The wedding won't be legally binding. "I don't know if there will, in fact, be a real marriage between Madonna and my son. It will be a type of ritual, but I do not know kabbalah [or if the ceremony] will have legal validity," says Luis, who doesn't seem upset that his evangelically raised son, a model, is converting to the branch of Judaism.

    In the interview, the elder Luz continues to spill the beans on his son's relationship, saying Madge and Jesus live together in her Central Park West apartment. He also denies rumors that Madonna is shelling out big bucks to teach her Brazilian stallion to speak proper English. "[Jesus] already spoke English very well before he knew Madonna!" he says indignantly, explaining: "He has an aunt residing in the United States."

    The young stud has also been playing surrogate manny to Madge's kids, says papa Luz. "She has small children, and Jesus helps her out with various tasks involving all of them. He plays ball with the kids. Jesus has charisma and loves children."

    Whatever the nature of their post-ceremony relationship, Jesus' dad heartily approves of his son's choice in women.

    "I've spoken by phone with Madonna - in French, because my English is not fluent - and she appears to me to be a normal and polite person," he says. "She is feminine. I don't feel she is a harsh person."

    We hate to inform you of the facts, Mr. Luz: Madonna may be a lot of things, but feminine she ain't!
