I tend to think of Vogue as being 80s in some way... :sleep: her last 80s hit that capped off that decade in style, it was recorded then and the video presumably shot very early 1990 with that hair transition. JML was the first 90s Madonna record sonically, more forward thinking and had nothing to do with her past and set the tone for what was to come (Erotica).

Either way 1990 was the biggest year of her career :ass:

A court rules that "no reasonable audience" would find the sampled portions of a 1976 composition significant "nor would they recognize the appropriation."

A lawsuit claiming that Madonna and producer Robert "Shep" Pettibone illegally sampled a tune on her 1990 international hit "Vogue," has been resolved with a ruling favor of the defendants.

The original lawsuit was filed in July by VMG Salsoul, the copyright owner of a 1976 composition called "Love Break." The plaintiff alleged that it was only through new technology that the "deliberately hidden" sampling had been detected.

But a U.S. District Court judge in California has ruled on summary judgment that sampling of the Horn hit was "trivial," in that in could not be recognized.

"Having listened to the sound recordings of Chicago Bus Stop, Love Break, and Vogue, the Court finds that no reasonable audience would find the sampled portions qualitatively or quantitatively significant in relation to the infringing work, nor would they recognize the appropriation," the ruling reads. "The Court finds that any sampling of the Horn Hit was de minimis or trivial."

Says attorney Richard Busch, who represented the defendants: "We are thrilled with the decision, and believe it is absolutely the right result."

Yes the lawsuit was completly irrelevant since Pettibone i the one who did the remix of LoveBreak used by voguers. He was basically sampling himself since he re-used his own remix.

A California federal judge on Monday agreed to award attorneys’ fees and costs to Madonna and others after their successful defense of a copyright suit over the 1990 hit single “Vogue,”.

U.S. District Judge Beverly Reid O’Connell said Madonna, producer Shep Pettibone and others were entitled to a total of $670,000 in fees and $50,055 in costs after winning a November ruling that plaintiff VMG Salsoul LLC couldn’t sue over a single horn chord allegedly sampled from the 1977 disco song “Love Break”.

"Having listened to the sound recordings of Chicago Bus Stop, Love Break and Vogue, the Court finds that no reasonable audience would find the sampled portions qualitatively or quantitatively significant in relation to the infringing work, nor would they recognize the appropriation, the Court finds that any sampling of the Horn Hit was de minimis or trivial."

The plaintiff alleged that it was only through new technology that the “deliberately hidden” sampling had been detected.

In march, it was reported that american recording artist Moby is being sued by VMG over alleged unlicensed sample use from 22 year old recordings.
