Madonna may be planning to adopt a baby from the African kingdom of Lesotho after being told to ‘expect the worst’ over her bid to become the new mother of Malawian girl Mercy James.

Her quest for another child could be the reason why the singer and her adopted son David Banda watched Prince Harry play at a polo match in aid of his charity Sentebale in New York last weekend.

The Prince has close links with Lesotho and Sentebale raises money for vulnerable children in the country, which has one of the highest AIDS rates in the world.

Madonna, 50, has an appeal pending in Malawi after a High Court ruling that she could not adopt four-year-old Mercy.

But The Mail on Sunday can reveal Madonna was warned last week that the three High Court judges considering the case are unlikely to rule in her favour when the verdict is made in open court later this month.

Prince Harry has strong links with Lesotho so is that why Madonna paid him a visit

The news comes almost a year to the day after she was officially granted permission to adopt three-year-old David from Malawi.

He now lives in New York with her two natural children, Lourdes, 12, and Rocco, eight, and Madonna is said to have promised David a new sister.

‘Madonna is not a patient person, she’s used to getting what she wants. She has said she won’t give up on Mercy but if she’s blocked from adopting her legally then she will think about trying to adopt another baby. She has already started looking into other African countries,’ a source revealed last night.

The family of Mercy say they do not want to let the young girl go

‘Madonna was devastated when she was told she couldn’t adopt Mercy. Her plan now is to start the ball rolling somewhere else. She has promised David a sister and she wants another African child.

‘If a miracle happens and she gets to adopt Mercy, I see no reason why she wouldn’t go ahead and adopt another child from a different African country as well.

‘She has done some research on Lesotho and because it’s a place that is ravaged by AIDS and has a high number of orphans, it could be the perfect second choice.’

In April, Malawian judge Esmie Chondo rejected Madonna’s application to adopt Mercy because the star does not fulfil the country’s residency requirements.

Prospective parents have to live in Malawi for 18 months before adopting an orphan.

But in other African countries residency is not part of the process.Madonna has sent a team of aides to Malawi in the hope that they can convince officials to let her have Mercy.

Sources in Malawi say the singer’s chief PA, her lawyer and a handful of representatives for her charity Raising Malawi are installed at Kumbali Lodge, where Madonna stayed in April when she tried to adopt Mercy.

But a source close to the star said: ‘Madonna has been told to expect the worst. She has a team in place in Malawi who have been campaigning tirelessly to try to facilitate the adoption. There was a private meeting between Madonna’s aides and a number of government officials last week.

‘Madonna’s representatives have been told the ruling, which is scheduled to be made public any day now, is not in her favour.’

David Banda's father seems happy with his son's care by Madonna during a visit to her Malwai lodge during a previous visit to the country

The singer argued in court papers that she was able to ‘securely provide’ for Mercy and ‘make her a permanent and established member of my family’.

One source in Malawi said: ‘There has been a lot of activity since Madonna’s people arrived. The officials from Raising Malawi checked in to Kumbali Lodge on May 29 and are booked in to the end of the month.

‘The lodge is not allowing other bookings, which is what happened the last time Madonna came in. There have been several meetings with government officials at the lodge, one of whom is an aide to Joyce Banda, the Vice-President of Malawi.

Madonna has promised David a sister, whether that be Mercy or another young orphan

'Madonna’s team have also made several visits to Blantyre, where the Supreme Court is. No one knows when the ruling is going to be made public. But the word here is that Madonna has been told the adoption is not going to happen.’

Madonna had hoped that the connections she has forged with Joyce Banda would help in her appeal to adopt Mercy, who is believed to be staying in a safe house.

A source in Malawi said yesterday: ‘Joyce Banda has publicly spoken out in support of Madonna and has said on the radio that Madonna is doing a good thing. She is on the committee of the school that Madonna is involved with in Malawi and has struck up a friendship with Madonna.

‘Joyce is due to visit the lodge soon but she hasn’t been yet. Sadly for Madonna, even their friendship and her good connections with the government don’t appear to have helped.’

David now lives in New York with Madonna and her two natural children Lourdes, 12, pictured above, and Rocco, eight

Last night Joseph Chigona, a spokesman for the Supreme Court, said that an official decision had not yet been reached.

‘We will inform the nation once the three judges are ready,’ he said.

Madonna’s US publicist last night insisted: ‘There has been no indication that a ruling is imminent. The adoption of Mercy is one of many rulings pending before the Court. There is no news on when the ruling is going to happen or that it will not be in Madonna’s favour. We remain hopeful.’

Jesus! Look at the state of Madonna

MADONNA is determined to go for an immaculate collection of kids by adopting an African baby with lover Jesus.

The star has switched her efforts from Malawi to Nigeria, making inquiries at an orphanage in the city of Kaduna about a female tot.

The Material Girl was devastated when her bid to adopt a little girl called Mercy was rejected by a Malawi court in April.

This time round she is involving model boyfriend Jesus Luz, 22, to prove he can act as a responsible father.

A source close to the 50-year-old singer revealed: "She was distraught when her adoption failed in Malawi.

"At the time she blamed the fact that her relationship with Jesus made her look like she was going through some midlife crisis.

"But now she's looking at adoption centres in Nigeria and has got another female friend to make an initial approach to test the waters.

"She's determined not to make the same mistakes and feels that the only way to do this is to get Jesus involved from the off." Madonna's pal has made an approach to the Mercy Home Orphanage, which is home to 30 children.

Our source said: "Madonna is considering visiting, perhaps with Jesus, as soon as she can."

But she may encounter problems similar to those she faced in Malawi, which ruled out adoption because she was not resident in the country.

Adoptive parents who have not been resident in Nigeria for at least three months find the adoption process extremely difficult.

A source said: "Madonna has some of the best legal minds working for her and she'll be pushing them to find a loophole."

She's determined to extend her family and provide a little sister for daughter Lourdes, 12, and sons Rocco, eight, and David, three, who she adopted in Malawi. The source continued: "Madonna always thought she would eventually win her battle to adopt Mercy, but that hasn't been the case. She thinks this will bring her and Jesus together as one big happy family."

Her friend added: "Failure is not an option. Madonna wouldn't be able to take rejection for the second time."

REPORT: MADONNA TO ADOPT FROM NIGERIA

Now that Malawai has rejected her, Madonna is reportedly looking to adopt a child from Lesotho, or even Nigeria.

Vanguard, a local Nigerian newspaper, published a report claiming that the 50-year-old pop star "is said to be considering" adopting a Mosotho child, but that "it has also been suggested" that she had discussed adoption with a Nigerian orphanage.

Madonna was apparently "warned last week" that Malawian judges were unlikely to grant her appeal against a judge's decision in April preventing her from adopting a second Malawian child, a girl named Mercy.

A souce tells the Mail on Sunday: "Madonna is not a patient person, she's used to getting what she wants. She has said she won't give up on Mercy but if she's blocked from adopting her legally then she will think about trying to adopt another baby. She has already started looking into other African countries… She has done some research on Lesotho and because it's a place that is ravaged by AIDS and has a high number of orphans, it could be the perfect second choice."

Madge's desire to adopt a second African child is likely the reason why she watched Prince Harry of Britain playing polo in New York City last week. The game was a benefit match for Sentebale, a children's charity in Lesotho which he and Prince Seeiso, the younger brother of King Letsie III, founded.

MADONNA GOES BABY SHOPPING IN OTHER AFRICAN COUNTRIES

Monday June 8th, 2009

After failing to adopt Mercy from Malawi, Madonna is reportedly shopping for kids elsewhere.

The Material Girl may be planning to adopt a baby from the African kingdom of Lesotho, according to the the Daily Mail, a British news site. Lesotho is a landlocked country entirely surrounded by South Africa and Prince Harry has close links with it. His charity Sentebale raises money for vulnerable children in the country, which has one of the highest AIDS rates in the world.

Mail reporter Katie Nicholl assumes Madonna’s “quest for another child is the reasons the pop diva watched Prince Harry play at a polo match in aid of his charity Sentebale in New York last weekend.”

Madonna is also making inquiries at an orphanage in Nigeria about a female child, according to News Of The World, a British celebrity news site.

Madonna, 50, has an appeal pending in Malawi after a High Court ruling that she could not adopt four-year-old Mercy, according to the Mail. But over the weekend the paper reported that the star was warned last week that the three High Court judges considering the case are unlikely to rule in her favor when the verdict is made in open court later this month.

In April, a Malawian judge rejected Madonna’s application to adopt Mercy because the star does not fulfill the country’s residency requirements. Prospective parents have to live in Malawi for 18 months before adopting an orphan. Also, Mercy’s family has stepped forward and said they’d like to keep the child.

The star is determined to extend her family and provide a little sister for daughter Lourdes, 12, and sons Rocco, 8, and David, 3, who she adopted in Malawi.

“Madonna is not a patient person, she’s used to getting what she wants. The star has “some of the best legal minds working for her” to find a loophole in Nigeria’s three-month residency requirement, according to News Of The World. “Failure is not an option. Madonna wouldn’t be able to take rejection for the second time,” a source said.

I don't question her motives at all. I just question why she always seems to want to adopt from places where it's so hard to do so. I thought Malawi was a fluke situation. She happened to go there, she was moved, she's started to be involved and she wanted to adopt....all very organic and natural. Hiring lawyers to find loopholes in the laws of other countries does indeed sound a bit shady, not illegal, just odd. Why not just choose to adopt a child without having to deal with all of this BS, lord knows there are plenty of them out there.

what MADONNA did in and for Malawi shouldn't make us question her motives at all...

I support her wherever she wants to adopt... in the end, it will always be one orphan she saves out of hunger with every adoption she makes... and they may someday be do-gooders themselves and bring grace to their native homes...

Wonderfull! She is inspiring!

That said the only loser is young Mercy, they stoped Her from having a home, but that did't stop Madonna she will still get a child, but Mercy loses.

You go Madonna!

well maybe she thinks the harder the country's law is for adoption, the worse the situation of homeless children there is... and maybe that's what she really wants to help, where need is at its most...

what we should question really is why governments are giving celebrities or people who likes to help their children have a better future have a hard time... as if they are doing a good job taking care of their orphans... what do they want, a scheme where they just ask MADONNA to send in the money and have them do their way with it? and again, shame on the media for discouraging other people like MADONNA from helping orphans...

MADONNA has persuaded three appeal judges to allow her to adopt Malawian orphan MERCY JAMES, The Sun can reveal.

Two have already submitted reports recommending it go ahead and the third is said to be "in complete unison with them".

Madonna, 50, whose two-year application to adopt the three-year-old was blocked by a court in March, has been told the news by her lawyer Alan Chinula.

The ruling is set to be announced next Sunday at Malawi's Supreme Court of Appeal.

A source there said yesterday: "The paperwork is being typed up now.

"All recommendations are in favour of the adoption taking place. Mercy should start packing her bags. She's off to America."

A close friend of Madonna said: "She's ecstatic.

"She made a promise that she wouldn't give up on Mercy and, believe me, she could move mountains when she's this determined."

Madonna's adoption application was originally rejected because she had not lived in the east African state for 18 months, as required.

But one of the three appeal judges has said that rule was out of date.

The pal added: "No stone has been left unturned to prove that ruling was wrong."

Mum-of-three Madonna has longed to adopt a sister for her adopted Malawian son DAVID BANDA, three.

I hope it's true. But I'm not going to get my hopes up because didn't the British tabloids say before, the adoption would go through.

I think it's the right decision to let her adopt Mercy so I certainly hope it's true.

Good to hear if true, but it's "The Sun". Isn't that just a tabloid?

Shame that Madonna goes on tour in less than a month. I would think Madonna would want to spend as much time as possible with Mercy to get her settled, before she treks all across Europe to tour again.

Malawi court to allow pop star Madonna to adopt Mercy, says lawyer

A pair of African courts have granted Madonna Mercy.

The Material Mom's lawyer says two appeals court judges in Malawi will allow her to adopt 4-year-old Chifundo "Mercy" James after all.

The judges in the east African nation have been persuaded to reverse their decision barring Madonna from adopting a child, and a third jurist is about to cave in, lawyer Alan Chinula told the London Daily Mail.

The official ruling will be announced Sunday at Malawi's Supreme Court of Appeal.

The move would clear the way for the 50-year-old pop star to get a sister for her son David, whom she adopted in Malawi in 2006, skirting the 18-month residency requirement.

It was that requirement that the three judges cited when they originally ruled against Mercy's adoption.

"A person is not entitled to claim to be a resident of a given town simply because he pays a short, temporary visit," Judge Esmie Chombo ruled at the time. "Some expectation of continuity is a vital factor."

Madonna's lifestyle -- including her divorce last year from British film director Guy Ritchie and reunion with former boy toy Jesus Luz, a model 28 years her junior -- also influenced the ban on adopting Chifundo, whose name means "Mercy" in English.

In an attempt to polish her tarnished image, Madonna has poured thousands of dollars into building a day care center in Malawi. The government has called her a worthy mother and supports a ruling allowing her to adopt.
