  1. Indonesia’s parliament votes to ban sex outside of marriage
    By Victoria Bisset | December 6, 2022 at 12:54 p.m. EST

Sex outside of marriage is to be punishable by up to one year in prison under a sweeping criminal code overhaul adopted by Indonesia’s parliament Tuesday, despite concerns from rights groups and many dissident voices.

Adultery is already illegal in the country, and other more restrictive measures are in place regionally. But the sweeping new measures would criminalize all extramarital sex between unmarried individuals and ban cohabitation before marriage, a major step for the world’s third-largest democracy.

The changes to existing legislation with roots in the colonial era have been decades in the making, and would apply to Indonesian and foreign nationals alike, after being passed by all nine parties in parliament. The new penal code needs to be sent to President Joko Widodo to sign, but will automatically pass into law after 30 days unless the president issues an objection. It is likely to take up to three years to be fully implemented, according to Edward Hiariej, the deputy law and human rights minister, the Associated Press reported.

The impact of the law depends in large part on how thoroughly it would be implemented and enforced — a question that remains open.

Human rights groups have long voiced concerns over various aspects of the proposed changes, which also outlaw insulting the president or vice president and challenging the Indonesian state’s ideology, and which expand upon an existing blasphemy law and would place restrictions on protests.

Under the new law, charges of adultery or cohabitation can only be brought by a spouse, parents or children, while insults against the president or vice president must be reported by the current holder of the office. A ministry official quoted by the Agence France-Presse news agency said these provisions would effectively limit the law’s use.

Some activists found cause for relief when — after fierce debate — a provision that would have criminalized gay sex was removed from the new penal code, according to the AP. However, Andreas Harsono of Human Rights Watch warned that the new rules could be used to “criminalize” members of the LGBTQ community in Indonesia, which does not recognize same-sex marriage.

“We have tried our best to accommodate the important issues and different opinions which were debated,” said Indonesia’s law and human rights minister, Yasonna Laoly, AFP reported.

There were also fears of the impact the new rules could have on the tourism industry and foreign investment, in light of the potential impact on international travelers and local staff.

“We deeply regret the government have closed their eyes,” the deputy chief of Indonesia’s tourism industry board, Maulana Yusran, told Reuters. “We have already expressed our concern to the Ministry of Tourism about how harmful this law is.”

A protest was held outside parliament earlier in the week, although it was much more contained than previous demonstrations against plans for a new criminal code. One such attempt to introduce new legislation in 2019 was met with widespread anger and mass nationwide protests, eventually leading Widodo to suspend the changes.

Indonesia is the world’s largest Muslim-majority country, and has the world’s largest Muslim population, but is ethnically and religiously diverse. In recent years, Islamist conservatism has gained prevalence in mainstream politics.

Stricter laws already apply in the semiautonomous province of Aceh, where a form of sharia law came into effect in 2015. Extramarital sex, same-sex behavior and drinking alcohol are among the acts punishable by public flogging in the region, according to Human Rights Watch.

  5. Malaysia Terengganu ramps up enforcement of unisex hair salon ban, warns of fine for offenders

TERENGGANU has reinforced its ban on unisex hair salons in the PAS-led state and operators who go against the gender-segregation licensing regulation will face a fine between RM500 and RM1,000.

According to state executive councillor Datuk Dr Alias Razak, this was not a new rule; rather, it is an existing licensing regulation under the jurisdiction of the local government.

The hair salon or barbershop, be it run by Muslims or non-Muslims, is not allowed to provide haircut services for both men and women at the same time,” he was reported as saying by Sin Chew Daily.

The state housing and local government committee chairperson further warned that operators who do not abide by the licensing regulations will face a fine or have their license revoked.

“There is no exemption for hair salons or barbershops run by non-Muslims. If we allow non-Muslim female hairdressers to provide haircuts for male customers, Muslim men may visit the shop,” he remarked.

During a debate session at the state assembly sitting on Tuesday (Nov 29) state assembly person Zuraida Md Noor called for enforcement action to be taken to ensure that barbershops and spas in the state observe Syariah requirements and gender-segregation regulations.

She said barbershops for men should only be managed by men and hairdressing salons for women should only be managed by women.

Zuraida further questioned the extent of which these regulations are complied with, adding that she had received complaints from locals who had voiced their concerns about men and women appearing in the same premise.

She also noted that this also happened in spas and beauty salons, and demanded to know how the hairdressing industry and beauty salons could overlook such a major issue.  — Dec 1, 2022

  6. Women Prostitutes Being Replaced By Sex Sheep & Camels In Kabul Brothels After Taliban Takeover

    afghansheep.jpg

The dozen brothels operating in Kabul before the Taliban victory have been emptied of their sex workers by the Islamists, whom replaced them with sheep and camels designated to be used for sexual activity.

Despite promises from the new Taliban regime to allow Afghan women to continue working and participating in public life, armed insurgents have already closed several “anti-Islamic” businesses in Kabul, including bars and brothels.

Various sources have reported Taliban fighters forcing women out of the various brothels across Kabul and replacing them with sheep and camels in concordance with the sharia, the Islamic law.

According to Margaret Smith, regional director of Human Rights Watch in Afghanistan, this is an important regression for Afghan women, whom she says are “treated worse than animals”.

    • “Sheep and camels have more rights under the Taliban regime than women. For them, sex for fun is with animals. Women are just walking wombs designed to bear and raise children.”

Ms. Smith fears this could be “just a first step” and that women could gradually be totally kicked out of public life by the new regime.

    • “They banned women from the world’s oldest profession to replace them with animals. I wouldn’t be surprised if they’d replace female secretaries with monkeys to humiliate them.”

    afghansheep2.jpg

Dozens of Afghan sex workers were kicked out of the various brothels allowed by the previous regime over the last few days, to be replaced by “sex animals” in concordance with the sharia.

During the Taliban rule in the 1990s, dozens of animal brothels were allowed across the country while human prostitution was severely repressed.

The group’s new leadership, seeking international recognition, made several promises concerning human rights, particularly women’s rights.

The treatment of Kabul’s sex workers suggests the Islamist organization is still extremely rigorous in its application of the sharia, despite its public promises.
